1. Agreement to Terms

By accessing or using Sparklepost ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Sparklepost provides a platform for social media management, customer support ticketing, and user feedback collection. This includes web applications, embeddable widgets, and related services.

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized use
  • You may not use another person's account without permission

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any laws in your jurisdiction
  • Send spam or unsolicited communications
  • Upload malicious code or attempt to compromise our systems
  • Impersonate others or misrepresent your affiliation
  • Interfere with or disrupt the Service
  • Scrape or collect data without permission

5. User Content

You retain ownership of content you submit. By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.

You are responsible for content you submit and must have the right to share it. We may remove content that violates these Terms.

6. Embeddable Widget

If you embed our widget on your website, you agree to:

  • Inform your users that data will be collected by Sparklepost
  • Obtain necessary consents as required by applicable law (e.g., GDPR, CCPA)
  • Not modify or reverse engineer the widget code
  • Use the widget only for its intended purpose

7. Payment Terms

Paid plans are billed in advance. Refunds are provided at our discretion. We may change pricing with 30 days notice. Failure to pay may result in service suspension.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Sparklepost and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

IN NO EVENT SHALL SPARKLEPOST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless Sparklepost from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law provisions.
